Non-Republicans have an unusual opportunity through Thursday to be able to vote in the Republican Primary for the 23rd Congressional District in the Southern Tier of New York, which includes Allegany County.
According to a new court order issued last week, any county voter is able to change their enrollment to Republican at the office of the Allegany County Board of Elections in Belmont by 4PM August 11 and vote in the Tuesday, August 23, Republican Primary.
The action is the latest in a sometimes difficult-to-follow series of events resulting from court cases associated with this year’s state redistricting, caused by the 2020 Census count in which New York State lost one Congressional seat.
The “normal” Primary occurred in June, with Republicans and Democrats being able to cast votes for nomination of gubernatorial and other statewide candidates.
The redistricting court battles placed a hold on the Primary for Congressional seats, however, with that date being established subsequently by the court for August 23.
In the meantime, 23rd District Congressman Tom Reed, who represented the Southern Tier, including Allegany County, resigned, leaving a vacancy in that position through the end of this year.
Gov. Kathy Hochul then ordered a special election to fill the vacancy, coinciding with the new Congressional Primary Day this month.
Therefore, individuals who are enrolled Republicans on August 23 will have an opportunity to vote for a candidate to appear on the November ballot for a full two-year term, with Nick Langworthy and Carl Paldino seeking that nomination to oppose Democrat Max Della Pia, who is unopposed for that party designation.
At the same time, all registered voters will be able to cast a ballot to elect a member of the U.S. House of Representatives to fill out the vacant post through the end of the year. Della Pia also is running to fill the vacancy, being opposed by Republican Joe Sempolinski who is not seeking the full term which starts next year.
The court order offers a unique opportunity for all county and Congressional district voters to cast ballots in the Republican primary within a short time frame before the vote by non-Republicans re-enrolling with the Board of Elections.
State residents normally must change enrollment by February to vote in a June party primary, different than some states which provide for open primaries in which enrolled party voters can cast ballots in other party primaries.
